U.S. Supreme Court won't hear Penn Yan man's appeal

The U.S. Supreme Court has refused to hear the appeal of a Penn Yan man convicted of DWI in 2009.

Robert Pealer intended to argue his right to confront his accusers was violated when prosecutors didn't call as a witness the technician who calibrated the Breathalyzer machine used in Pealer's arrest.

He also claimed officers lacked sufficient cause for the traffic stop. Prosecutors says it was Pealer's fourth DWI conviction.
